Product Warranty

Gasko Innovation Sdn. Bhd. assures that, in accordance with the stipulations articulated in this Standard Product Warranty Statement, the products furnished by Gasko (as outlined on our website https://www.gasko.my) will be suitable for their intended purpose throughout the designated warranty period as defined by our warranty terms and conditions.

Warranty Period

The validity of the Warranty Period is contingent upon the existence of manufacturing defects within the products provided by Gasko and endures for a duration of three (3) months commencing from the date of your acquisition of Gasko equipment product, unless otherwise specified in a distinct warranty document indicating an extended duration. It is imperative to note that this warranty statement expressly EXCLUDES all types of dry ice or solid carbon dioxide products of Gasko.

Exclusions from our Warranty coverage

Our Warranty shall not apply in the following circumstances:

  1. This Warranty shall not apply to products that have not been utilized, installed, or upheld in accordance with our documented specifications, instructions, suggestions, shelf-life restrictions, technical data sheets (as periodically published at https://www.gasko.my), and any acknowledged general or industry standards (inclusive of relevant Malaysia Standards). Furthermore, this exclusion encompasses adherence to building codes, approvals, or regulations applicable at any given time.

 

  1. This Warranty does not cover defects arising from various circumstances including but not limited to: incorrect storage or installation, substandard workmanship, pre-existing conditions, structural failure, structural movement, substrate movement or failure, engineering or design defects, insufficient or subpar engineering, inadequate preparation, inappropriate product selection, unauthorized product alteration, misuse or abuse, unapproved product modification, moisture or water damage, hydrostatic pressure, efflorescence (relevant to cement mortars and grouts), regular wear and tear, exposure to unusually corrosive environments, accidents, fire, intrusion by pests or insects, negligence not attributable to us or our authorized representatives, or acts of nature (including, but not restricted to, storms, cyclones, floods, earthquakes, and other natural disasters).

 

  1. This Warranty does not extend to discrepancies in colour, shape, or texture as compared to representations in samples, product packaging, or marketing materials. Additionally, it does not encompass changes resulting from exposure to sunlight, unless explicitly stated in our technical specifications that the product is UV tolerant. It should be noted that this exclusion applies even when considering fading due to aging or reasonable wear and tear.

 

  1. This Warranty shall not apply to products used or installed outside of Malaysia, or to products not distributed by Gasko through wholesale or retail channels. Voiding of Warranty may occur under the following conditions:

 

  • If our product is utilized, combined, or associated with other manufacturer’s products without obtaining our written consent.
  • If our product is not employed or installed as part of our recommended Gasko product system, where applicable.
  • In instances where we, at our discretion, request access for inspection before work commencement or upon project completion, or to oversee the work intermittently, and access is denied to us or our authorized representatives.
  • If upon filing a claim, we or our authorized representatives are denied reasonable access to physically inspect, conduct testing, and obtain samples related to the allegedly defective product.
  • If you or a third party have attempted to rectify or substitute the alleged defect prior to notifying us of your claim or without obtaining our written approval.
  • To the extent that losses or damages result from products not produced or supplied by us or any cause other than a manufacturing defect in our product.
  • To the extent that you could have prevented damage or further damage but failed to do so.

How to make a claim

For any claims under our Warranty, you are required to provide written notification to us within 7 days from the identification of the alleged manufacturing defect. This notice should be directed to:

Your claim submission must include evidence of purchase, specifying the date of purchase, installation site, and a comprehensive description of the claimed defect. Moreover, you are obligated to promptly supply any additional information we may reasonably request in connection with your claim.

It is important to note that you shall bear the costs incurred in submitting a claim under our Warranty. In the event that your claim is determined to be covered by our Warranty, we will be responsible for covering expenses related to inspections, testing, and other relevant procedures carried out in relation to your claim.

By initiating a claim, you acknowledge that should we reasonably determine that the claimed defect is not within the scope of our Warranty coverage, you shall promptly reimburse us upon demand for all reasonable documented expenses we have incurred in relation to your claim. This reimbursement includes, but is not limited to, costs associated with inspections, testing, and other activities undertaken as part of your claim submission.

Your Exclusive Remedy

Subject to the terms and conditions stipulated within this document, our Warranty exclusively encompasses the repair or replacement at our discretion of the specific segment of our product that has been conclusively determined to be defective due to a manufacturing flaw. This coverage includes reasonable labour costs associated with repairing or replacing the product, ensuring that such costs do not exceed the original expense of installation. In instances where a replacement product is unavailable, we reserve the right to offer a product of comparable quality. Please note that an exact match in colour or pattern may not always be attainable. It is important to emphasize that the initiation of a replacement or repair procedure does not extend the duration of the applicable warranty period.

In alignment with the terms of our Warranty and any obligations that cannot be legally excluded, we do not assume liability for any direct, indirect, or consequential losses or damages (including, but not limited to, profit losses or disruptions to business operations) that may arise, whether due to negligence or any other cause, from your direct or indirect utilization of our product.
